Ohio Bill would require fencing along rail trails Trail advocates in Ohio have expressed concern about the following bill (H. B. No. 353) in the State of Ohio legislature would require fencing along rail trails. It is sponsored by State Representatives TAYLOR, METELSKY, and BRITTON National Public Radio had a feature on this on February 1, 2000.
BILL To enact section 1519.021 of the Revised Code to require the Director of Natural Resources to erect and maintain a privacy fence between a state recreational trail used for hiking or bicycling and private land that is adjacent to the trail upon the written request of the owner of the land. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: Section 1. That section 1519.021 of the Revised Code be enacted to read as follows: Sec. 1519.021. (A) AS USED IN THIS SECTION, "PRIVACY FENCE" MEANS A BARRIER THAT IS CONSTRUCTED OF NONTRANSPARENT MATERIAL, IS AT LEAST SIX FEET IN HEIGHT, AND IS ERECTED AND MAINTAINED SO AS TO OBSCURE ADJACENT LAND FROM THE ORDINARY VIEW OF INDIVIDUALS WHO ARE PASSING UPON STATE RECREATIONAL TRAILS USED FOR HIKING OR BICYCLING. (B) IF AN INDIVIDUAL WHO OWNS LAND THAT IS ADJACENT TO A STATE RECREATIONAL TRAIL USED FOR HIKING OR BICYCLING SUBMITS A WRITTEN REQUEST FOR A PRIVACY FENCE TO THE DIRECTOR OF NATURAL RESOURCES, THE DIRECTOR SHALL ERECT AND MAINTAIN A PRIVACY FENCE BETWEEN THE INDIVIDUAL'S LAND AND THE ADJACENT STATE RECREATIONAL TRAIL.
